U.S. deserter seeks asylum in Germany

After being questioned by authorities for nearly nine hours at the German Federal Office for Migration and Refugees on Wednesday, U.S. Army Spc. André Shepherd felt tired, but also ‘‘full of hope to win the battle that had just started," according to his lawyer, Reinhard Marx.

And a legal battle it will surely be.

The 31-year old soldier from Cleveland, Ohio, went "Absent Without Leave" in April 2007 when he walked off his unit’s base near Katterbach, Germany.

He said he deserted because he did not want to return to what he calls a "completely illegal war" in Iraq. He is believed to be the first American deserter to plead for asylum with German immigration authorities.

Shepherd’s case is unique in Germany, but he is not alone across Europe. According to Bruce Anderson, a spokesperson for the U.S. Army in Europe, Shepherd is among 71 Army soldiers to desert European bases in 2008.

If he is granted asylum, his case could create new legal options for soldiers looking to escape the military, his supporters say. But rejection of his case could find him handed over to military authorities and could lead to a longer jail sentence.

"I take it a day at a time," Shepherd said in a phone interview. "And I will pursue what I believe is the right thing. They can't punish you for something that is right."

Moral conflict
The ring tone on Shepherd‘s mobile phone is James Brown singing "I feel good. I knew that I would," and he sounds just as enthusiastic and confident about his asylum case when he answers questions from journalists. 

"When I enlisted in 2004 and later was sent to Iraq, I believed I was doing the right thing," he said. "But then, like other comrades around me, I started questioning why we were there and what we were fighting for."

Shepherd was not directly involved in combat missions during his deployment to Iraq. As part of the "attack and lift unit" of the 412th Aviation Support Battalion, Shepherd’s mission was to repair and maintain AH-64 Apache helicopters.

"My job was harmless until I factored in the amount of death and destruction those helicopters caused to civilians every day," Shepherd said.

"The government made us believe we would be welcomed as heroes in Iraq, but we saw nothing but hostility from the Iraqis that came to work for us, they wanted to kill us," Shepherd said.

His base outside of Tikrit was shelled almost every night, which he said also left him unsettled.

"It is not the military itself that is bad," Shepherd said. "In fact, our unit did a lot of good things, giving schools books and bringing clothes to children." Those actions helped ease his conscience a bit, but he still questioned whether the Iraqis would have needed the aid if the United States had not invaded Iraq in the first place.

Hiding out with peace niks and punk rockers
When he was ordered to redeploy to Iraq in April 2007, Shepherd felt that he could not continue to serve and went AWOL.

He went into hiding for a time and lived with a motley crew of new-found friends – a group of punk rockers in a traditional Bavarian village near the Austrian border, as well as peace activists.

But he was growing increasingly nervous about being caught by the U.S. Army, so last November he applied for asylum. Ever since, he has been living with asylum seekers from Africa, the Balkans and the Middle East – including Afghan and Iraqi civilians, who fled instability and violence in their countries – at a refugee-processing center in southern Germany.

Despite the initial akwardness, Shepherd finds it very rewarding to be able to talk to people from Iraq.

"The Iraqi citizens I meet are often shocked to see an American soldier amongst them and, almost every day, I feel like I have to apologize to them for what the U.S. has done to their people, but many of them are interested in hearing my story," he said.

Long legal road
In early 2008, Shepherd sought help from the Military Counseling Network, a German non-governmental organization that provides free counseling for soldiers who have gone AWOL or seek a discharge from the military.

"We told him there is not a lot that can be done when you go AWOL, especially because he did not meet the criteria for a conscientious objector, so André brought up the possibility of seeking political asylum in Germany," said Tim Huber of the Military Counseling Network. 

Marx, Shepherd's Frankfurt lawyer, acknowledged that the case will not be easy one. "This would set an extreme precedent and has a certain amount of sensitivity on a foreign policy level," he said.

Meantime, as far as the U.S. Army in Europe is concerned, Shepherd is a deserter and was reported as such to local authorities.

In a written statement, the U.S. Army said that it is "aware of Shepherd's request for asylum. However, the U.S. Army is not a party to the asylum process, which is completely in German hands." The statement said that "the U.S. Army is not seeking to participate in the asylum proceedings."

Following Wednesday’s  hearing, German authorities will now thoroughly investigate the merit of Shepherd's claim. Because of the strong legal and political implications that a decision in this case could have, the process will likely take several months.

No one agrees with the stupid occupation of Iraq, but you have to do your duty.
Hum maybe to much German nite life made him miss movement. Happened to me. I took my punishment and joined my brothers for the fun filled, all expenses paid Middle East Vacation, no big deal.

No one likes being here. But you gotta do what you signed up for.

Hope Obama will stop all this invading other countries thing.

The Germans should give him back and we should lock him up and throw away the key.  He enlisted in the Military and no one made him sign up.  
I despise everything about the Iraq War and those that lied to us to get us into it but unfortunately as a soldier once you put on that uniform you are bound by a different set of rules. I joined the Army while Viet Nam was going on,I didn't support the war in Nam and requested duty in Europe,which I got,but at the same time I knew that if the Army ordered me into combat in Nam or elsewhere I was duty bound to go,that's part of being a soldier.
Leavenworth would be a good place for him to think about his actions for about 20 years.

Hope he is turned down for asylum.  Apparently he was homeless before joining the Army.  So now this guy runs off once given an actual job to do?  His request for asylum is a slap in the face of every other soldier who does their duty.

I am a disabled US Army retiree who was honorably discharged. I see incidents like this and they make me sick and very disappointed in my fellow solidiers. If he felt so bad and determined that this war is illegal, he did not have to desert to satisfy his problem. He could have gone through the proper Army channels to solve his new problem. In my view this man is a coward and should be court martialed.
I dont understand Andre's reason for going awol. On one breath he speaks of all the good he did in Iraq and the other of all the bad he helped create for working on attack helicopters. In war you cant have it both ways. I feel this is really his copout from probably being redeployed to Iraq or Afghanistan.

Allow these deserters to renounce their U. S. citizenship and stay there. It is better for everyone.
Germany 'owes' mankind. I hope they will look deeply into their hearts and souls and do this brave man justice. He appears to be asking to only live a life of his own and not be forced to be a tool in the endless murder of civilians in an illegal war. Help him, you 'good Germans." He wasn't drafted, it was and is a volunteer Army. I was in and I took my oath seriously. No matter were he was sent or what he was made to do, he chose to put himself into the service of our country. It's not up to him to choose which battles to fight. He should be tried as a desrter and face the consequences.

I understand, there is no draft, so I assume this person enlisted in the military voluntarly. With that said..did he not realize that just perhaps he would be sent into combat?  Thats what our military is for, to defend and honor out country. Desertion is a crime and should not be looked upon as some soft hearted GI thinking he can crawl under some rock in another country.  Do his job, whether he agrees with the job assigned or not. I hope the Germans tell him go pound salt, go back home and face what you have done, and be man enough to do the time in Levenworth.

First of all this pisses me off seeing this guy go AWOL for being a mechanic. You joined the service to FIGHT AND DEFEND your country and the CONSTITUTION. If you go AWOL during wartime you are punishable by death so I hope they get this coward.
Coward
This deserter swore an oath upon enlistment to protect and defend the Constitution.  He's failed on that oath.  The Uniform Code of Military Justice makes it quite clear the ramifications of opting out on that oath, including being an AWOL deserter.  He's shamed himself, his fellow soldiers, the US Army and the United States, by deserting his post.  He should be punished accordingly. I'm not interested in hearing his sob story about how he couldn't handle doing his job anymore.  He knew what he was getting into when he enlisted.  
This guy enlisted AFTER the war had started.  That it came as a shock to him that he had to fight is an outrage...I am a veteran who enlisted BEFORE the war started.  When my unit was called up, I disagreed.  I was appalled.  But I went, and I served.  My opinion should not affect the job I do.  He never objected to receiving that paycheck, now did he?  
This soldier enlisted, not drafted, and was stationed in Germany. It is a disgrace that he would desert while in Germany, or any other country. His obligation is to his country and not a political issue. I too have a son in Iraq and have a political view but am proud that his fellow soldiers are his concern not the politics.

If Germany accepts his request then Germany will likely get a very cold response from America. This man should not be granted asylum. He's a coward and should be sent to Afganistan not jail.

Lets see he had to join voluntarily to get in, must be he wanted some kind of a bonus for joining? then decided he was not man enough to serve.  Or is he a Muslim who has no character?
The guy is a coward who should have never enlisted in the first place. Every soldier is told in Basic Combat Training that they could one day actually have to be a SOLDIER and go to war. Heaven forbid you actually have to DO the job that you signed up for...
Andre Shepherd should go to military prison for twenty years period. He sighned up for it and he should abide by his contract with the U.S. ARMY.
THIS MAN FREELY JOINED THE MILITARY. HE SWORE TO OBEY THE COMMANDS OF HIS SUPERIORS AND HIS COUNTRY.  HE HAS TAKEN THE MONEY AND BENEFITS AS LONG AS IT WAS IN HIS BEST INTEREST.  SOLDIERS DO NOT HAVE THE RIGHT TO DECIDE FOR THEMSELVES IN WHICH BATTLES THEY WILL PARTICIPATE AND WHICH THEY WILL NOT.THE MAN IS SCARED AND JUST WANTS OUT OF THE OBLIGATION HE FREELY MADE TO HIS COUNTRY.  I SURELY HOPE THAT IF HE IS GRANTED ASYLUM THAT THE USA REVOKES HIS CITIZENSHIP PERMANENTLY.
unfortunately our soldiers are having to explore other methods of ending the irag war.  when are we going to use common sense and stop this farce of a war.  i don't blame this soldier, i blame congress for getting us into this mess.

he is nothing but a cower iam very sure that he was fine when he was getting all of the army benefits, but dont this people know that once you joing the service at one point in time you are going to have to defend your country no matter where they send you and do what ever it takes its just common sence, why do they joing makes no sence to me
Too bad he didn't think about the consequences when he signed up for the military.  I am sure all the men/women sometimes think to themsevles - what have I gotten myself into.  But, they stay and do their time and then get out with an Honorable Discharge.  I for one could never ever think of not being a US citizen.  I thank every service person out there for all you do and all you sacrifice each and every day.  God bless you all and please know - we do appreciate your patronage.  I know I don't agree with the war but I do respect what all service men do.  They made a commitment even if it is not what they thought they signed up for.  The proud daugheter of an Army Korean War veteran.
I know Lefties will think this guy is a hero, but every person who joins the military (myself included, 20 years ago) KNOWS that combat is a possibility, regardless of what justifications are made for whichever war may happen top break out during your enlistment. You are joining the UNITED STATES MILITARY; put in place to defend, at all costs, the American way of life. If going to a foreign land to fight with combat arms, and risking life and limb is something you are diametrically against, I would suggest you stroll right past the recruiter's office. This man stood in a room with however many other recruits at the MEPS in Downtown Cleveland, raised his right hand and swore to defend America against all enemies, foreign and domestic. He doesn't get to choose his war zone. I hope Germany doesn't set a dangerous precedent and allow this DESERTER, this back-turner, to be freed of his military obligations. I hope he is given an Article 15, discharged dishonorably from the Army, and flown to Leavenworth to serve a long sentence for dereliction of duty and desertion. He is every bit a traitor in my opinion. Prosecute and label him accordingly. Sure....grant him political asylum. Then extradite him to the United States to face trail for desertion.

There are far better ways to deal with objectionable aspects of your chosen profession.  Bringing dishonor to your comrades, the Army, and the United States was a poor choice.....likely just one of a long series of poor choices this gentleman has made.
Throw him in jail until he rots, he is a traitor to the United States and his fellow soldiers.  I wish there was a way to strip him of his citizenship, he shouldn't ever be allowed to return to the United States and the military should file a civil suit against him in Germany and take back his sign-on bonus.
What ever happened to personal honor in this country? This guy should be prosecuted and sent to prison just like any other deserter. I hope he does realize that a military court can sentence him to be shot for desertion. Maybe the reality of that would stop these coardly worms from going "AWOL". I spent my time in a hell hole and I didn't whine and run away like a coward. I expect all servcemen to serve with honor.
We have an all-volunteer military. He VOLUNTEERED! If he wants to refuse to fight on moral grounds, then do it the right way and face military justice. They would have slapped him on the wrist and discharged him. This is just attention seeking.
This is so rich!  I knew you didn't have to be smart to join the army, but I didn't know they accepted people that had such a deep and profound respect for the plight of the people of Iraq.  I hope the army has the nads to make an example out of this retard when they get him back.
Men and women have put on the uniform and taken an oath to defend our nation.  No war is ever a popular war.  Viet nam was heavily critisized as was Korea.  There were even those who felt we should have stayed out of World War I & II.  But once you sign the papers and go in you are in until your contract is up.  This is not an option.  He has deserted and should be punished for his actions.  To allow him to get away with this would set deadly precendence.

It is and has been an ILLEGAL WAR, all bets (sign-up-promisses) are off. He is a curageous, and brave man and I admire him for his BRAVE actions. Have we had more like him, this country would be far better. We all know that Bush lied about the WMD and he (bush) got us into the war for the OIL.  I say again WELL DONE Andre, and may God Bless You.
He's so upset about the poor civilians? People need to realize that there has never been a war fought in human history in which civilians did not die. Then they can sign up for the military knowing before hand there will be poor civilians.
For all of you who think it's ok to quit, you must the ones who never finished a project, chore or anything...what have you every produced or provided to society except failure?
This person volunteered and took an Oath to defend the country and obay the orders of his superiors. When things got "tough", he bailed out i.e. read deserted, and now wants off the hook. You take the ggod with the bad.
The guys is embarassing... i did my 10 years, you sign up, you are not forced by the way, you do your time... He should be made an example of and locked up, the the other candy butt's might think twice before us citizens spend money and time training for a prosperous future... he is a wuss..
